Definitions

Service center — person or company which give the customer's services

Service is given by the Service center to the User on the contract basis with the Executor, and also another network services named and not named in the present contract Conditions having auxiliary character or used by an unlimited group of persons.

The user — the party of the contract with the Service center, and also the third parties who are not consisting in contractual relations with Service center, but addressing to center, or co-operating with center.

To use the services you should express firstly your consent with Conditions.

You don't have the right to use the service if you don't accepted the Condition.

You can accept the Conditions:

• By choosing an option "to accept Conditions" or "to agree with Conditions" if such option is given in the user interface of such Service;
• Or actually using the Service. In this case you understand and agree that we will regard the fact of using you Services as the form of acceptance of Conditions since the corresponding moment of time.

You don't have the right to use the services and cannot accept the Condition if you are the person to whom according to legislation BVI or any other state, including the states which resident you are or from which territory you carry out using of Service, use/reception of such Services is forbidden.

Using of Services

To get access to certain Services, from you can be request some personal information (for example, data for the person or contact data) as a component of registration process to start using Services or as authorization part of continuation of using Services. You agree that any information which you give to Service during the registration is always exact, correct for this moment.

• You agree to use this service only for the purposes resolved (a) Conditions and (b) any applicable laws, positions either the standard practice or managements in corresponding jurisdiction (including any law, concerning data export and the software from BVI or other corresponding states)
• You agree do not provide access (and do not try to get access) to any Services by a different ways, except as through the interface given by Service, except the cases when such actions have been directly allowed for you according to the separate agreement with Service.
• You agree do not carry out any activity which conflicts or interferes with Services granting (or work of corresponding servers or the networks, which connected to Services).
• You agree do not reproduce, do not duplicate, do not copy, do not sell, do not carry out trading operations and do not resale Services for any purposes, except for cases when such actions have been directly allowed for you according to the separate agreement with Service.
• You agree, that you have exclusive responsibility (and that service center does not have responsibility for you or any third parties) for any infringement of your obligations established by the present Conditions, and also for all consequences of such infringements (including any losses or damages which Service can have).

Stopping of the relations with service

Conditions are subject to application till the moment of the termination of their action by your initiative or by the initiative of Service center, as specified below.

• If you wish to stop the agreement with Service center, you can make it (a) by granting to Service of the notice about it in any time, and (b) by closing of all your accounting records for all Services which you used if Service has given you such option of the agreement termination.
• Service has the right to stop any time the agreement with you, if You have broken any points of Conditions (or have made actions which obviously specify, that you do not going to or are not capable to observe points of Conditions); or
• Service should do it owing to the law (for example, in cases when granting to you of such Services is or becomes illegal); or
• Service center stops granting of Services to the users located in territory of the state which resident you are or from which territory you use services; or granting to you Services from Service center, which from Service center's point of view, becomes not commercially benefit.

In case of cancellation of the present Conditions, such termination does not influence any rights, obligations and responsibility which have been got by you or Service which were applicable to you or Service (or which have arisen during action of Conditions) or in which relation it is directly specified, that their action is not limited by time.

Guarantee exclusion

Services are given "as it is", and Service does not give you any guarantees concerning the Services. In particular cases, Service, does not give any assurances or guarantees that:

• Using Services by you will meet your requirements;
• Use of Services by you will not interrupt, always will be accesible int any time convenient for you, will be safe or will not be subject of errors or failures;
• Any information received by you as a result of using Services by you, will be exact and authentic, and defects of Software work given to you as a part of Services, will be corrected;
• To Services are not accepted any conditions, guarantees or other positions (including any meant conditions concerning satisfactory quality, conformity of a definite purpose of use or conformity to the description), except that are directly specified in Conditions.
• Positions of the present Conditions do not influence to the action of the rights provided by the law belonging to you as the consumer which owing to the contract you cannot change and which you cannot refuse.

Limitation of responsibility

Positions of the present Conditions do not exclude and do not limit responsibility of Service for causing of losses, in that degree in which such responsibility cannot be excluded or limited in force of the applicable legislation.

In condition of observance the regulations of the general character Service does not have responsibility in relations with you for:

• Any losses indirect or arisen are owing to something which you can have. It includes any missed benefit (haven expressly or by implication), any damage of reputation and any loss of data haven by you;
• 2 any loss or damage which you can have as a result of:
• That you relied on completeness, accuracy and existence of any advertising, or
• As a result of any relations between you and any advertiser or the sponsor, whose advertising takes places in Services;
• Any changes which Service center has the right to bring in Services, or as a result of the termination (on a constant or time basis) granting of Services (or any separate function or Services property);
• Removals, failure or impossibility of communication data preservation containing in Services or transferred by means of using by Services;
• That you didn't give to the Service the exact information in the accounting record;
• That you could not provide safety and confidentiality of your password or data about your accounting record;
• Limitation of Service responsibility in relations with you, are subject to application without dependence on, whether Service knew or should know about possibility of occurrence of any such losses.

Advertisement

Granting of some Services is financed at the expense of advertising incomes, and Services can contain advertising. Such advertising can be addressed depending on the including information, kept from using Services, with a character of the inquiries which are carried out by means of using by Services or depending on other information.

The order, the form and volume of the advertising, placed in Services, can vary without granting to you of the separate notice.

For counter granting in the form of the permission to you from Service center access to Services and using Services, you agree, that Service has the right to place such advertising in Services.

Other information

Services can include hyper-references to other websites, to other content or resources. Service can do not have the control concerning any websites or the resources given by other companies or persons.

You recognize and agree, that Service does not have responsibility for availability of any such external sites or resources, and Service did not approve any advertising, products or other material accessible on such websites, resources or by means of such websites or resources using.

You recognize and agree, that Service does not have responsibility for any losses or damages which you can have as a result of access possibility presence to such external websites or resources or because you relied on completeness, accuracy and existence of any advertising, product or other materials on such websites, resources or by means of using such websites or resources.

Change of Conditions

Service has the right to make from time to time changes in given conditions After doing of such changes Service will give the new version of conditions on the reference.

You understand and agree that if you use Services after date of entering of respective changes in Conditions, Service will regard the fact of using you Services as acceptance of new Conditions by you.
